Hopefully you will never be involved in a wrongful death case. These cases involve nothing but heartbreak, stress, revenge, and extreme emotional roller coasters.

However, if you find yourself in a situation where you have to put forward a claim of wrongful death, there are several things you should know.

Wrongful death claims are very different from all other types of personal injury claims. The main difference in these cases is that the actual victim is not the claimant.

The claimant is usually a parent or guardian who has suffered from the loss of a child. The claimants may also be the dependants who depended on the person who died for income.

A claim can only be made when the death occurred because of negligence of some kind. The dependants are legally entitled to receive compensation for the death of their loved one.

Negligence is known as anything that the person could have done to prevent the death and did not do. In normal personal injury claims the person who was injured petitions for compensation.

Under the original Common Law, the dependents could not receive compensation for a wrongful death. However, all of the States soon adopted a clause of one kind of another that allowed the dependants to seek financial support since their former means of financial support was taken from them.

The elements of a wrongful death include carelessness in the conduct of the person who caused the death, this person is also accountable because of negligence, the person who died left behind a spouse, children or other dependants, and the dependents are suffering because of lack of finances following the death.

The rules related to Delayed Discovery Doctrine vary between states so make sure you do your research before you become too involved and then disappointed. Keep in mind that if there are multiple heirs they must all file jointly.

There cannot be several cases opened related to the same person. The object of this compensation is to make up for economical losses, not emotional losses.
